Will the registry help protect developers from criminal prosecution and support innovation?

Against the background of tougher legislation on foreign non-profit organizations (NPOs) in the field of IT, industry representatives expressed concerns about possible criminal prosecution for cooperation with foreign NGOs. In this context, market participants turned to the Ministry of Digital Development with a proposal to create a register of destructive NGOs operating outside of Russia, in order to protect "bona fide" developers from criminal prosecution.

The proposal was sent to the Minister of Digital Development Maksut Shadaev and Deputy Chairman of the State Duma Committee on Information Policy Anton Gorelkin. Software development associations have proposed that the ban on cooperation with foreign NGOs that do not have branches in the Russian Federation should apply only to those organizations that are included in the proposed register.

The main reason for this proposal is due to the fact that current legislation actually prohibits Russian developers from participating in the international open source movement. In particular, this applies to cooperation with organizations such as the Linux Foundation, Python Foundation and Apache Software Foundation, which in turn restricts the development of domestic IT products created using open source code, for example, Russian operating systems based on the Linux kernel: Alt Linux, Astra Linux, Red OS, Rosa Linux, "Atlant", "Osnova" and "Lotus".

Representatives of the IT industry hope that the creation of the register will help reduce the risks of criminal prosecution for developers who actively cooperate with "bona fide" foreign NGOs. The Ministry of Digital Development agreed with this initiative, noting that the proposal will help in shaping approaches to risk mitigation and will be used in developing joint solutions with the Ministry of Justice.

Thus, this proposal reflects the desire to balance the need for international cooperation for the development of the domestic IT industry and the need to ensure national security in the digital sphere.
