10 years later: hacker escapes punishment for hacking the Pentagon

The Supreme Court of Cassation of Kuwait has decided to release from criminal liability a well-known Kuwaiti hacker who hacked hundreds of websites around the world, including the Pentagon website.

The hacker was accused of breaking into the website of the US Department of Defense, gaining access to classified weapons data and hacking 200 American websites. Some of the sites contained confidential information belonging to the United States.

The Supreme Court of Cassation upheld the verdict of the Court of Appeal, according to which the 28-year-old accused cannot be held accountable for crimes committed 10 years ago (the break-ins occurred between 2010 and 2012).

On October 9, 2023, the International Criminal Court (ICC) dropped the criminal case against the hacker. The court also dropped the charge that Kuwait exposed relations with the United States to the risk of rupture due to hacking the Defense Ministry's website.

In addition, the hacker was accused of embezzling money fraudulently, using the hacked site to attract victims to subscribe for viewing content. The court found that hacking activities cannot be prosecuted due to the expiration of the statute of limitations, which caused mixed emotions among the public and cybersecurity specialists.
